These terms and conditions (“Terms”) are for bookings made with Just Boarded (“we”, “us”, “our”) a company registered in England and Wales with a registered number 10742879), whose registered office is at: 27, Old Gloucester Street, London WC1N 3A.
1. The contract
a. Client, “you” and “your” (“Client”) means or refer to any person who enters into a contract with Just Boarded. “Trip” refers to any trip, tour, event or challenge organised by Just Boarded.
b. “Force Majeure” means any circumstances which are unusual and/or unforeseeable which are beyond the control of Just Boarded, the consequence of which could not have been avoided even if all due care had been exercised, including (but not limited to) war or threat of war; riot; civil strife; hostilities; political unrest; government action; industrial dispute; natural or other disaster; nuclear incident; terrorist activity; weather conditions; closure of airports; fire; flood; drought; re-scheduling or cancellation of flights or alteration of the airline or aircraft type by an airline and technical problems with transportation and all similar events outside our control.
c. All bookings are made with Just Boarded. By booking a trip with us you are deemed to have agreed to these Terms and any booking conditions (“Booking Conditions”). Please read these Terms and any Booking Conditions carefully as they set out your respective rights and obligations.
d. Where there is any conflict or inconsistency in any of these Terms or any issued agreement or Booking Conditions these Terms shall prevail.
e. In these Terms and any Booking Conditions references to “you” and “your” include the first named person on the booking and all persons on whose behalf a booking is made or any other person to whom a booking is added or transferred.
a. You are required to pay a non-refundable deposit (unless we cancel the Trip for any reason other than Force Majeure situations) of £200/€200 per person per trip for your booking to be confirmed.
b. Payment of the deposit or full balance from the Client acts as an acceptance to these Terms.
3. Acceptance of booking and final payments
a. If we accept your booking we will issue a confirmation (“Confirmation Invoice”).
b. A contract will exist between us from the date we issue the Confirmation Invoice.
c. Final payment is due minimum 4 months (122 days) before departure. If this balance is not paid on or before the due date we reserve the right to treat your booking as cancelled.
d. If you have any special requests you should inform Just Boarded before booking or as early as possible before departure. We will try at our own discretion to meet these requests but cannot guarantee to do so and cannot be held liable for our failure to do so.
4. Prices and surcharges
a. Prices are based on the maximum size of a group and can change depending on the size of your group, the demand, the market conditions, availability or special requests made by you.
b. Payments made by credit card will incur a 2% fee. Prices are based on currency exchange rates as of June 2017; note that prices may vary depending on which currency the booking is made.
c. We reserve the right to impose surcharges up to 122 days before departure due to unfavourable changes in exchange rates, increases in transportation costs, increases in local operator costs, taxes, or if government action should require us to do so. In such instances we will absorb any amount up to 2% of the trip price and you will be responsible for the balance. If any surcharge results in an increase of more than 10% of the trip price you have the option to cancel the booking within 14 days of notification of the surcharge and obtain a full refund.
d. We will not add a surcharge after final payment has been done.
e. You are responsible to pay for your personal equipment, tips, international flights, VISA, vaccinations, additional food & drink, personal spending money, transport to and from the airport of your country of departure, and any other activities not included in the itinerary.
f. All discounts and reduced pricing are applied at our discretion. From time-to-time we may offer reduced pricing on selected trips.
g. The reduced pricing applies strictly to new bookings, and bookings that have already been confirmed are locked into their original price and are not entitled to the reduced pricing. You can only use one promotional code at a time.
h. Price changes after you have booked
- Prices of trips may be altered after you have booked on account of UK government action, changes in exchange rates, transportation costs and dues, taxes or fees charged at ports or airports.
- If price changes are imposed by us as a result of UK government action we will charge or refund the consequences of such changes in full.
- Visas, vaccinations, connecting air flights or other expenses incurred as a result of your booking or your expectation that you would travel on the trip.
i. If the provisions as set out in h3 or the balance or full payment due is not received by Just Boarded by the date specified in the Confirmation Invoice, and unless a delay in your payment has been agreed by Just Boarded in writing, we reserve the right to cancel your booking and to retain your deposit. We also reserve the right to pursue you for the unpaid balance due.
5. Your details
a. At the time of booking, along with paying your deposit, you will be required to provide us with basic information, such as your name, email address and phone number.
b. Once your booking has been confirmed, you will then have until the final payment is due to complete the remainder of the information that we require, such as diet, allergies, next of kin, passport details etc.
c. If you fail to provide the requested details it may result in additional charges or non-refundable cancellation of your trip.
d. We must pass the information on to the relevant suppliers of your travel arrangements such as local operator, hotels, transport companies or security, customs and immigration if required by them, or as required by law.
e. We will not, however, pass any information on to any person not responsible for part of your Trip arrangements.
f. In making this booking, you consent to this information being passed on to the relevant persons.
6. Minimum age
a. Participants must be a minimum of 18 years old on the Trip departure date and be in suitable physical condition to undertake the Trip as set out in the itinerary.
b. Participants should be fully aware of the possible risks inherent in adventure travel. 16-17 years olds may also participate in Trips, with the agreement of, and when accompanied on the Trip by their parent or guardian. We reserve the right to cancel any Trip without compensation for any parent of guardian who refuses to sign any reasonable disclaimer for those persons under the age of 18 years old.
7. Risk and medical problems
a. You understand and you are aware that physical activity involved in outdoors trekking is a potentially hazardous activity and can involve a risk of injury and even death, and that you are voluntarily participating in this activity. Save for the provisions of clause 17 you hereby agree to expressly assume and accept all and any risks of injury or death.
b. We are not medical experts. It is your responsibility to ensure that you obtain proper and detailed medical advice prior to travel for the latest health requirements and recommendations for your destination.
c. By booking a Trip you do hereby declare yourself to be physically sound and suffering from no condition, impairment, disease or infirmity or other illness (other than those declared in writing to Just Boarded).
a. You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives.
b. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.
c. It may be necessary for reasons beyond our control to alter advertised arrangements both before leaving the UK and once the trip has begun. The itineraries given for each expedition must therefore be seen as an indication of what you will achieve and not as a contractual obligation on our part. No refunds will be given if changes for such reasons occur.
a. Your Trip may be taking place in a country where travel and accommodation standards are less developed than you are used to in the UK or your country of residence, and where we have little control over the quality of internal travel and accommodation arrangements, which may vary in quality and the degree of comfort provided and may also differ from their description given by us in good faith in our brochures, leaflets and website.
b. Standards of accommodation will vary from basic (no showers) to comfortable (3* hotels or guesthouses). The Trips are based on using twin rooms (where applicable).
10. Authority on tour
a. Our group Trips are run by a local guide. Their main role is to look after the safety and well-being of any traveller or staff member participating in the trip. Therefore the decisions of the guide are at all times final and you undertake to follow the instructions given to you.
b. If you do not follow the guide’s instructions and your behaviour is considered to be dangerous, or irresponsible to yourself or the rest of the group, then you may be requested to leave the trip immediately.
c. The grounds for such a decision being made may include, but not be confined to, a belief by the leader or guide that
- an individual’s health or life is at risk.
- an illegal act has been committed.
- someone’s behaviour has or is likely to be seriously detrimental to the enjoyment of the trip by the group or detrimental to its well-being or safety.
d. A request for person(s) to leave a Trip will give those person(s) no right of refund.
e. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited.
11. Cancellation and changes made by you
a. If you cancel your trip, cancellation fees will apply. A cancellation will only be effective when we receive written confirmation.
b. If you cancel a trip:
- 122 days or more prior to departure, we will retain the deposit;
- between 61 and 121 days prior to departure, we will retain the deposit and 50% of the final payment already paid to us, and;
- 60 days or less prior to departure, we will retain the deposit and 100% of the final payment already paid to us.
c. You are strongly advised to take out cancellation insurance at the time of booking as your insurance policy may refund much of your costs if cancellation is due to certain specified factors, please check directly with them.
d. If you leave a trip for any reason after it has commenced we are not obliged to make any refunds for unused services.
e. If you fail to join a Trip, join it after departure, or leave it prior to its completion, no refund will be made.
f. In the event that you wish to change/amend/postpone your trip, it needs to be requested to us in writing. We will make every effort to assist you. You will be charged a £50/€50 administration fee for each amendment and will be subject to covering any additional charges.
g. If the new itinerary chosen has a higher deposit or final payment you will be responsible to pay the difference.
h. Changes will be valid only after receipt of payment. 121 days or less before departure, no change of itinerary can be done, only name change (£50/€50 administration fee plus any charges levied by hotels or ground operators).
i. No amendments at all are permitted to your booking within 15 days of departure.
12. Cancellation and changes made by us
a. Whilst every attempt is made to ensure that planned trips actually run we may cancel a trip at any time prior to departure if, due to Force Majeure, or other external events, it is not viable for us to operate the planned itinerary.
b. If we cancel your trip for any other reason (other than Force Majeure), you can transfer the amounts paid to an alternate departure date (if there is availability) or receive a full refund.
c. We are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.
d. Should a significant change become necessary we will inform you as soon as reasonably possible.
a. The price of your trip includes:
- All accommodation as listed in the itinerary.
- All transport as listed in the itinerary.
- Sightseeing and meals as listed in the itinerary.
- The services of a local guide and a support team as described in the itinerary.
a. The price of your trip does not include:
- International or internal flights unless specified.
- Meals during free time.
- Visa and passport fees.
- Travel insurance.
- Personal expenses (extra drinks, snacks, souvenirs, etc).
- Local Doctor (can be hired for an extra fee).
- Vaccinations and medications.
- Personal kit and equipment.
15. Passport and visas
a. It is your responsibility to ensure that you are in possession of all necessary travel and health documents before departure and for ensuring that you meet any foreign entry requirements.
b. A full and valid passport is required for destinations we feature (including children) and Visas (transit, business, tourist or otherwise) may be required for some destinations and depending on the passport you hold.
c. Requirements may change and the length of time it is likely to take to obtain the appropriate passports and visas will vary. It is your responsibility to check the up to date position and you should make any applications for passports and/or visas in good time before your departure.
d. You must carry a valid passport and have obtained all of the appropriate visas, permits or certificates for the country which you will visit during your trip.
e. Your passport must be valid for 6 months beyond the duration of the trip.
f. We can provide general information about the passport and visa requirements for your trip, but this is for guidance only and we are not responsible if you are refused entry to a country because you lack the correct passport, visa or other travel documentation.
g. For further information contact the Passport Office on 0300 222 0000 or visit their website.
h. Up to date travel advice can be obtained from the Foreign and Commonwealth Office.
i. Non British Citizens, including other EU nationals, should contact the Embassy, High Commission or Consulate of your destination, for up to date advice on passport and visa requirements.
16. Travel insurance
a. It is mandatory to be covered by Travel and Cancellation Insurance and should be taken out at the time of booking.
b. Your travel insurance must provide cover against personal accident, death, medical expenses, emergency repatriation and more specifically for the adventurous activity undertaken on this trip.
c. We also strongly recommend it covers cancellation, curtailment, personal liability and loss of luggage and personal effects. You must send a copy of your travel insurance policy to us before departure. Failure to do so will result in your booking being cancelled.
a. We will accept liability for the negligence of our staff causing death or physical injury to persons or loss or damage to personal property only to the extent it is obliged under the applicable law.
b. Our obligations, and those of our suppliers providing any service or facility included in your trip, are to take reasonable skill and care to arrange for the provision of such services and facilities. This acceptance of liability is subject to clause 17e below.
c. Please note that it is your responsibility to show that we or our supplier(s) have been negligent if you wish to make a claim against us.
d. In other circumstances we are responsible to you for the proper performance of this contract. This acceptance of liability is subject to clause 17e below.
e. We will not be responsible or pay you compensation for any injury, illness, death, loss, damage or expense, cost or other claim of any description if it results from:
- The act(s) and/or omission(s) of the person(s) affected.
- The act(s) and/or omission(s) of a third party unconnected with the provision of the services contracted for and which were unforeseeable or unavoidable.
- Unusual or unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised.
- Political disputes, border closures, refusal of visas, industrial action, climate or other matters of a similar nature and any other Force Majeure.
- An event which either ourselves, agents or suppliers could not, even with all due care, have foreseen or forestalled.
- If you decide voluntarily to leave any Trip, Just Boarded has no responsibility for your safety or wellbeing or for any consequential expenses.
- The consequences of any independent arrangements that you make.
f. We limit the amount of compensation we may have to pay you if we are found liable under this clause:
- For loss of and/or damage to any luggage or personal possessions and money, the maximum amount we will have to pay you is the excess of your insurance policy total because you are assumed to have adequate insurance in place to cover any losses of this kind.
- Where Just Boarded is found to be liable to damages in respect of failure to carry out its contract the maximum amount of such damages, compensation and loss of enjoyment will be limited to twice the cost of the Trip shown in the invoice.
g. Where the damages relate to the provision of transport by air, sea or rail or hotel accommodation any compensation payable will be limited by the relevant Conventions.
h. We will not accept responsibility for services or facilities which do not form part of our agreement or where they are not advertised by us. For example any international flights, excursion you book whilst away, or any service or facility which your hotel or any other supplier agrees to provide for you.
i. It is a condition of our acceptance of liability under this clause that you notify any claim to ourselves and our supplier(s) strictly in accordance with the complaints procedure set out in these conditions.
j. Please note, we cannot accept any liability for any damage, loss or expense or other sum(s) of any description which on the basis of the information given to us by you concerning your booking prior to our accepting it, we could not have foreseen you would suffer or incur if we breached our contract with you.
k. While we have made every effort to ensure the accuracy of our advertising material and information sheets we cannot be held responsible for any inaccuracies.
18. Foreign and Commonwealth Office Advice
a. The Client acknowledges that they are responsible to make themselves aware through Foreign Office advice, State Department warnings and any other sources available to them in regard to the safety of the countries and areas in which they will be travelling and to make their decisions accordingly.
b. Whilst we will do our best to inform clients of relevant changes to the FCO Travel Advice, it is up to the Client, and not Just Boarded, to know what the FCO travel advice to a certain country, or region of a country, is and to be adequately insured to travel there.
c. Just Boarded accepts no liability if the Client (i) chooses to cancel a booking because of FCO advice or (ii) is not adequately insured to travel.
d. Just Boarded will not normally cancel a trip simply because the FCO advise against travel.
19. Data Protection
Just Boarded will at all times comply with the provisions of the Data Protection Act 1998 (”DPA 1998”) or any subsequent amendment thereto and shall ensure that its agents and employees are trained in and comply with the data protection principles set out in the DPA 1998.
a. Although we make every effort to ensure the accuracy of the website regrettably errors do occasionally occur and we reserve the right to correct prices and other details in such circumstances.
b. You must therefore ensure you check the price and all other details of your chosen arrangements with us at the time of booking.
c. Please contact us immediately if any of the information you receive from us appears to be incorrect or incomplete.
21. Claims & complaints
a. We will do our very best to ensure that your travel arrangements go according to plan.
b. However if you have a complaint while on your trip please inform your guide immediately so he can attempt to rectify the matter.
c. If satisfaction is not reached please get in touch with us as soon as possible by email. For any other complaints please advise us within 28 days of returning home, in writing, with all other relevant information.
22. General Information
a. We give advice and information on matters such as health, vaccinations, visas, currency, local conditions, climate, equipment, clothing and other matters in good faith and cannot be held responsible for such advice and information.
b. You accept responsibility for all these matters and particularly for obtaining the necessary visas and advice from your own doctor on all health matters.
23. Photos and marketing
You consent to us using any media (including photographs and/or video footage) made of you during the trip for advertising and promotional purposes including, but not limited to, brochures, websites, marketing material and in the media. If you do not wish for your image to be used you must inform us, in writing, at the time of agreeing to these Terms.
These Term and any agreement made with Just Booking is governed by and construed in accordance with English law and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
